Terms and Conditions for Mash Creative

Welcome to MashCreative (“the Agency,” “we,” “us,” or “our”). By accessing our website https://mashcreative.co.za or engaging our creative services, you agree to be bound by the following Terms and Conditions.

1. Services

MashCreative provides professional creative services, including but not limited to:

  • Brand Strategy and Identity Design
  • Graphic Design
  • Web Design and Development
  • Digital Marketing (SEO, PPC, Social Media Management)
  • Content Creation

2. Quotations and Proposals

  • All quotes are valid for 30 days from the date of issue.
  • Quotes are based on the initial brief provided by the Client. Any changes to the scope of work after the quote has been accepted may result in additional charges.
  • Acceptance of a quote (via email or signed proposal) constitutes a formal agreement.

3. Payment Terms

  • Deposit: A non-refundable deposit of 50% is required before any work commences, unless otherwise agreed in writing.
  • Final Payment: The remaining balance is due upon completion of the project and prior to the release of final files or the website going "live."
  • Late Payments: We reserve the right to charge interest on overdue accounts at a rate of 2% above the prevailing South African prime lending rate.
  • Monthly Retainers: For ongoing services (e.g., Social Media Management, SEO), invoices are issued monthly in advance and are due within 7 days of the invoice date.

4. Client Responsibilities

  • The Client agrees to provide all necessary materials (logos, copy, images, etc.) promptly.
  • Delays in providing information may result in project timeline extensions.
  • The Client warrants that they own the rights to, or have obtained permission for, any materials provided to us. The Client indemnifies MashCreative against any legal action related to the use of these materials.

5. Proofing and Revisions

  • Each project includes a specific number of revision rounds as outlined in your proposal (typically 2 rounds). Additional revisions will be billed at our hourly rate.
  • Final Approval: Once the Client provides final approval (sign-off) via email, MashCreative is not liable for any errors (spelling, layout, etc.) discovered thereafter. Any corrections requested after sign-off will be subject to additional fees.

6. Intellectual Property (IP)

  • Agency IP: We retain ownership of all preliminary sketches, concepts, and working files.
  • Final Deliverables: Upon full and final payment, ownership of the final "approved" design/website is transferred to the Client.
  • Showcase Right: Unless otherwise requested in writing, MashCreative reserves the right to showcase the completed work in our portfolio and marketing materials.

7. Web Hosting and Maintenance

  • If we provide web hosting, we aim for 99.9% uptime but do not guarantee it. We are not liable for losses caused by hosting outages, third-party plugin failures, or security breaches (hacking) beyond our reasonable control.
  • It is the Client's responsibility to maintain website security and updates unless a "Maintenance Package" has been purchased.

8. Cancellation and Termination

  • Either party may terminate the agreement with 30 days' written notice.
  • If a project is cancelled by the Client after work has begun, the Client will be billed for all work completed up to the date of cancellation, in addition to the non-refundable deposit.

9. Limitation of Liability

To the maximum extent permitted by South African law, Mash Creative Co. shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising from the use of our services or website. Our total liability is limited to the amount paid by the Client for the specific project in question.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
